Introduction
These Terms and Conditions form the contract between Premium Hosting and the person or organisation purchasing or using a service (“you”). They should be read with the order summary, Acceptable Use Policy, Privacy Policy and any product-specific terms shown before purchase.
Section 1 — Eligibility and acceptance
1.0 Contracting with us
1.0.1 You must be at least 18 and legally capable of entering a binding contract. If you order for an organisation, you confirm that you may bind it.
1.0.2 Your order is an offer to buy the identified services. A contract is formed when we accept the order or begin provisioning it, whichever occurs first. We may reject an order, including where information is incomplete, payment fails, a fraud check is not satisfied or a requested service cannot be supplied.
1.0.3 Product-specific terms prevail over these Terms only for the relevant product and only to the extent of a conflict.
Section 2 — Accounts and security
2.0.1 You must provide accurate, current account and billing information and keep your authentication details confidential.
2.0.2 You are responsible for activity authorised through your account. Tell us promptly through the support route if you suspect unauthorised access.
2.0.3 We may restrict an account where reasonably necessary to protect customers, services, payment systems or the public, or to investigate suspected misuse.
Section 3 — Orders, prices and payment
3.0.1 The service, initial price, billing interval, applicable tax and available renewal information are shown during checkout. Prices may differ between initial and renewal periods where this is clearly disclosed.
3.0.2 Recurring services renew for the interval shown at checkout until cancelled. You authorise the selected payment method to be charged for amounts falling due. You must keep that method current.
3.0.3 We may change future prices by giving the notice stated in the customer portal or product-specific terms. A price change does not remove any statutory right you have.
3.0.4 If payment is overdue, we may restrict, suspend or terminate the affected service after any applicable notice or grace period. Data loss may follow termination, so you must export required data before a service ends.
Section 4 — Cancellation and refunds
4.0.1 Cancellation must be requested through the cancellation facility or authenticated support route identified in the customer portal. Cancelling a payment authority alone does not cancel a service.
4.0.2 Consumer cancellation rights depend on the service, when supply begins and whether you expressly requested immediate performance. Nothing in these Terms limits rights that cannot lawfully be excluded.
4.0.3 Any voluntary money-back guarantee, refund or service credit applies only where its eligibility period and exclusions were displayed when you ordered. Domain registrations, certificates, licences, third-party charges and consumed resources may be non-refundable where permitted by law.
4.0.4 Unless the order terms, a service credit or applicable law say otherwise, we do not provide a pro-rata refund for an unused part of an active billing period.
Section 5 — Hosting, cloud and VPS services
5.0.1 You receive a limited, non-transferable right to use the purchased service during the paid term and within its published limits.
5.0.2 You are responsible for your applications, configuration, credentials, content and lawful use. An unmanaged VPS requires you to administer and secure the operating system and installed software unless a separate managed service says otherwise.
5.0.3 No availability target or service-credit scheme applies unless it is expressly included in the accepted order. Maintenance, emergency work and events outside reasonable control may affect access.
5.0.4 Resource descriptions such as bandwidth, storage or usage are subject to the purchased plan and the Acceptable Use Policy. We may contact you to resolve usage that threatens platform stability or other customers.
Section 6 — Backups and customer data
6.0.1 You must maintain an independent, current backup of important data unless your order expressly transfers that responsibility to us.
6.0.2 A backup feature is not a guarantee that every file, database or restore point will be available. Backup scope, frequency, retention and restore access depend on the purchased product.
6.0.3 After cancellation or termination, service data may become unavailable and be deleted according to the operational retention schedule. Residual copies may remain temporarily in protected backups before expiring through normal rotation.
Section 7 — Domains, certificates and third-party products
7.0.1 Domain registrations are subject to availability and the rules of the relevant registry and registrar. You must provide accurate registrant information and comply with those external terms.
7.0.2 A domain is not registered until confirmed by the relevant registry. Registry action, disputes, eligibility rules and expiry can affect a domain independently of us.
7.0.3 You are responsible for reviewing renewal notices and maintaining a valid payment method. Redemption, restoration or transfer charges may apply after expiry.
7.0.4 Software licences, SSL certificates and other third-party products may have separate supplier terms that form part of your order.
Section 8 — Acceptable use and suspension
8.0.1 You must comply with our Acceptable Use Policy and applicable law. You must not use services to harm others, interfere with systems, send unsolicited communications or host prohibited material.
8.0.2 We may remove material or suspend a service where reasonably necessary to stop harm, comply with law or a competent authority, protect infrastructure, investigate misuse or address a material breach. Where appropriate, we will explain the reason and steps needed to restore service.
Section 9 — Support
9.0.1 Support covers the service boundary described for the purchased product. It does not include customer code, third-party applications or unmanaged server administration unless separately agreed.
9.0.2 Response and resolution times are targets only where expressly included in an applicable support plan or SLA.
Section 10 — Intellectual property and customer content
10.0.1 You retain ownership of your content. You grant us the limited rights needed to host, transmit, back up and otherwise process it to provide and protect the services.
10.0.2 You confirm that you have the rights and permissions needed for content you provide and that it does not infringe another person’s rights.
10.0.3 Our website, branding, software and documentation remain owned by us or our licensors. No ownership transfers to you.
Section 11 — Liability
11.0.1 Nothing excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot lawfully be excluded.
11.0.2 Subject to clause 11.0.1 and applicable consumer law, we are not liable for indirect or consequential loss, or loss of profit, revenue, business, goodwill or anticipated savings.
11.0.3 For business customers, our aggregate liability connected with a service is limited to the amount paid for that service during the 12 months before the event giving rise to the claim, except where a product-specific agreement expressly provides otherwise.
Section 12 — Termination
12.0.1 Either party may terminate in accordance with the cancellation provisions and any minimum term shown at checkout.
12.0.2 We may terminate immediately for a serious or repeated breach, unlawful use, a material security risk or where continuing the service would breach law or supplier requirements.
12.0.3 Clauses intended to continue after termination—including payment, intellectual property, liability and dispute provisions—survive termination.
Section 13 — General legal provisions
13.0.1 These Terms, the accepted order and incorporated policies are the entire agreement about the service. If one provision is unenforceable, the remainder continues.
13.0.2 A delay in enforcing a right is not a waiver. You may not assign the contract without our written agreement; we may assign it as part of a reorganisation or transfer of business provided your rights are not materially reduced.
13.0.3 Neither party is responsible for delay caused by events outside its reasonable control, but payment obligations already due remain payable.
13.0.4 English law governs the contract. The courts of England and Wales have jurisdiction, except that consumers retain any mandatory rights to bring proceedings in their home jurisdiction.
Section 14 — Changes and contact
14.0.1 We may update these Terms for legal, regulatory, security, supplier or service changes. Material changes affecting an active service will be notified through an appropriate account or email route before taking effect where practicable.
14.0.2 Questions about these Terms should be sent to sales@premium-hosting.co.uk. Complaints are handled under our Complaints Procedure.
